Trackeon Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Trackeon Golf, LLC ("Trackeon," "we," "us") governing your use of the Trackeon mobile app (the "App") and the website at trackeongolf.com (the "Site," and together with the App, the "Services"). By accessing or using the Services, downloading or installing the App, creating an account, or submitting a Site form, you agree to these Terms. If you do not agree, do not use the Services.
1. What Trackeon is
Trackeon is a golf launch-monitor App for iOS and Android. Using your phone's camera and microphone, it performs on-device analysis to estimate full-swing and putting metrics such as ball speed, club speed when available, launch angle, spin, carry and total distance, and simulated putting roll. It also lets you maintain a golf bag, track shot history and stats, optionally stream calculated shot data to a companion display through a QR-code-linked session, and connect calculated shot data to supported golf-simulator software on your local network. The Site provides information about Trackeon and forms for beta registration, contact, support, and privacy requests.
Raw camera video and microphone audio used for analysis are not uploaded to Trackeon's servers or sent to connected simulator software, with one beta-only exception: if you allow automatic failed-capture uploads, when a swing-processing attempt does not produce a successful tracking result, the App automatically uploads the saved swing-capture file (a short encoded video window plus camera and tracking metadata, available on iOS and Android) after you leave tracking to help us diagnose and improve tracking. You may change that choice in Account and may also choose to upload other saved swing captures manually. Our Privacy Policy explains the information the Services store, process, and disclose, including these beta uploads.
2. Estimates only
Shot and putting metrics produced by the App are estimates intended for entertainment, practice, and general training. They are generated by device-based sensor analysis and simulation and are not certified measurements or a substitute for a professional launch monitor, club fitting, coaching, or medical or physical advice. Results can vary with the device, setup, environment, equipment, swing, putting surface assumptions, and connected software. Do not rely on the App's output for equipment purchases, competitive rankings, wagering, safety decisions, or any purpose requiring certified accuracy.
The optional elevation lookup estimates terrain elevation above sea level using Google's Elevation API. It does not measure the phone's altitude or the camera's height above the ground. Approximate device location and source-data limitations can affect the estimate. Verify or correct the value for your setup; do not rely on it for surveying, navigation, safety, or other purposes requiring an accurate altitude measurement. The Google Maps Platform subsection below describes the Google terms that apply to this feature.
3. Safe use
Golf activity can cause serious injury or property damage. You are responsible for using the App safely. Securely mount or position your device, use an appropriate hitting area and protective equipment, confirm adequate clearance, and follow all facility and equipment rules. Do not swing or hit a ball when a person, animal, device, or property is in the possible path of the club or ball. Stop using the App if it distracts you or creates an unsafe condition.
4. Accounts and age requirements
- You may create an account with an email and password, Google Sign-In, or, on supported Apple devices, Sign in with Apple. An account is required to use the App.
- You must be at least 13 years old — or the minimum age required to consent to data processing in your country, if higher — to create an account. If you are under the age of legal majority where you live, your parent or legal guardian must review and accept these Terms and supervise your use of the App.
- You must provide accurate information and keep supported account information current.
- You are responsible for safeguarding your device and account credentials and for activity under your account. Notify us promptly if you believe your account has been compromised.
5. Privacy and your data
Our Privacy Policy explains how we collect, use, disclose, retain, and delete information. You retain ownership of the shot data and swing-capture files you provide or generate through the App. You grant us a limited license to host, process, transmit, and display that data only as needed to provide, secure, support, and improve the Services and as otherwise described in the Privacy Policy, including receiving failed-swing captures during the beta if you allow automatic uploads, receiving other captures you manually upload, and transmitting calculated shot data to a companion display or simulator destination you select.
Calculated shot records are retained for the life of your account unless you delete a shot or your account. Deleting an individual shot does not currently recalculate cumulative lifetime stats.
Your selected elevation is saved locally on your device, whether entered manually or obtained through automatic lookup. It is shared across setup screens and retained after restarting the App until you replace or clear it or remove the App's local data. It does not automatically change when you move to another location. Revoking location permission or signing out does not automatically clear that setting. Our Privacy Policy explains the coordinates sent for lookup, Google's processing, and your controls.
6. Free access and subscriptions
- New accounts may start one seven-day period of free access by tapping the start button in the App. The seven days begin when you tap, not when you create the account. This free-access period is provided by Trackeon, is not an Apple App Store or Google Play introductory trial, does not require payment information, and does not automatically convert into a paid subscription.
- After free access ends, continued use requires a subscription. The App displays the available billing periods and the price supplied by your device's store before purchase. Payment is charged to your Apple App Store or Google Play account when the purchase is confirmed.
- Subscriptions renew automatically for the same billing period unless you cancel through your store account before the end of the current period. You can review, change, or cancel a subscription from Account → Manage subscription in the App or through your store's subscription settings. Deleting your Trackeon account or removing the App does not cancel a store subscription.
- Price changes, refunds, billing disputes, payment methods, and cancellation timing are administered under the rules of the store that processed the purchase. Except where law requires otherwise, access continues through the paid period after cancellation and payments are non-refundable by Trackeon. You may request any available refund through the applicable store.
- Purchases and restores are associated with both your store account and your authenticated Trackeon account. If a purchase is not recognized, use Restore purchases or Account → Manage subscription. Do not share account credentials or attempt to apply one purchase to multiple unrelated Trackeon accounts.
7. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the App's source code, algorithms, or underlying models, except to the extent applicable law permits that activity despite this restriction.
- Abuse, overload, disrupt, damage, or interfere with the Services, a connected simulator, or related infrastructure.
- Attempt to gain unauthorized access to the Services, our systems, a connected device, or another person's account or data.
- Circumvent security or access controls.
- Use the App for unlawful, fraudulent, harmful, or infringing purposes.
- Submit malicious code or content or use automated means to scrape or access the Services without our permission.
We may investigate suspected violations and take proportionate action, including restricting access, as permitted by law.
8. Account deletion, suspension, and termination
- You may stop using the App at any time. You may delete individual shots or delete your account from the Account screen in the App.
- When account deletion completes, the active account and associated profile, bag, shot, aggregate-stat, and uploaded swing-capture records are removed. Limited security, authentication, diagnostic, legal-compliance, and backup records may remain temporarily as described in the Privacy Policy.
- We may suspend or terminate access if we reasonably believe you violated these Terms, abused the service, created risk or legal exposure, or harmed Trackeon, another user, or our infrastructure. Where practical and legally permitted, we will make reasonable efforts to notify you.
- Provisions that by their nature should survive termination, including ownership, warranty disclaimers, liability limitations, and dispute provisions, will survive.
- Deleting your Trackeon account does not cancel a subscription billed by Apple or Google. Cancel the subscription through your store account before deleting your Trackeon account if you do not want it to renew.
9. Service availability and changes
The Services are being offered as developing services, including during beta. Features and compatibility may change, and we may modify, suspend, or discontinue some or all of the Services. We will provide notice when reasonably practical if a change materially affects the Services. We do not guarantee that stored data or any particular feature will always be available, so you should not use Trackeon as your only record of information you need to preserve.
10. Third-party services and simulator integrations
The Services rely on third-party services, including Supabase for backend and authentication services, Google's Elevation API for optional terrain-elevation lookup, RevenueCat for subscription status and purchase management, Sentry for diagnostics and feedback, PostHog for App and Site analytics, Google Sign-In and Sign in with Apple for optional authentication, Resend for account email delivery, Expo/EAS Update for App updates and infrastructure, Webflow for Site hosting and forms, Cloudflare for Site bot protection, and Apple and Google for App distribution, payments, and platform services. Google Maps Platform — Elevation API only
The App includes Google Maps features and content solely through the Google Maps Platform Elevation API, which supplies terrain elevation for coordinates submitted at your request. This is our only Google Maps Platform API integration. Google Sign-In is a separate, optional authentication service.
Your use of the Google-provided elevation feature and content is subject to the then-current Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy, which are incorporated by reference for that use. Google and its licensors retain their rights in Google-provided content; these Terms do not grant you ownership of that content or rights beyond the applicable Google terms. If you do not agree to those terms, do not use automatic lookup; you can enter elevation manually instead.
Automatic lookup requires a signed-in, non-guest account, an Internet connection, and device location permission. Selecting the location button requests that Trackeon send your approximate coordinates through its backend to Google's Elevation API. Requests are subject to account limits, provider availability, and provider terms. A lookup may fail or be temporarily unavailable; you may enter a value manually or retry when permitted. You must not bypass request limits, automate bulk extraction of elevation data, or use this feature in violation of the applicable Google terms. We may restrict, suspend, or terminate access to the Google-provided feature when needed to address such violations.
Simulator integrations
If you choose to connect the App to GSPro or OpenGolfSim, you direct the App to send calculated shot measurements to the local-network host and port you enter. You are responsible for using a trusted network and destination device. These integrations use provider-defined TCP protocols and may not be encrypted. You must obtain and maintain any simulator software, account, license, subscription, equipment, and network access required by the provider. Trackeon does not provide or sell GSPro or OpenGolfSim.
GSPro and OpenGolfSim are independent third-party products. Trackeon is not affiliated with or endorsed by their providers, and their names and marks belong to their respective owners. Their availability, APIs, compatibility, data handling, and features may change without notice. We do not guarantee that an integration will connect, remain compatible, accept a shot, or calculate or preserve results accurately. Your use of GSPro is subject to the GSPro Terms and GSPro Privacy Policy. Your use of OpenGolfSim is subject to the OpenGolfSim Terms and OpenGolfSim Privacy Policy.
OpenGolfSim's current terms state that its services are only for users who are at least 18 years old. You may not use Trackeon's OpenGolfSim integration unless you satisfy that requirement and every other eligibility condition imposed by OpenGolfSim. GSPro's terms require a parent or guardian to review, accept, and supervise use by a minor.
We are not responsible for third-party services or software to the extent permitted by applicable law.
11. Intellectual property and license
The Services, including their software, design, branding, and content other than user data, are owned by Trackeon Golf, LLC or the applicable licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable (except where applicable platform terms permit), revocable license to use the Services for their intended purpose on devices you own or control, subject to these Terms and applicable platform rules. No other rights are granted.
The Services include third-party and open-source software governed by separate license terms. Applicable copyright notices and licenses are available with the App or from us on request. Those licenses control if they conflict with these Terms concerning the third-party software.
Feedback you voluntarily provide about Trackeon may be used without restriction or compensation to improve the App, provided we handle personal information in that feedback according to the Privacy Policy.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services or third-party integrations will be uninterrupted, error-free, secure, or compatible with every device or third-party product, or that shot metrics, putting simulations, transmissions, acknowledgements, or stored information will be accurate, complete, or suitable for any purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, Trackeon and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business, or goodwill, arising from or related to the Services or these Terms, even if advised that such damages were possible.
To the maximum extent permitted by applicable law, our total aggregate liability arising from or relating to the Services or these Terms will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, if any, or fifty US dollars (US$50), whichever is greater.
Some jurisdictions do not allow certain exclusions or liability limits. In those jurisdictions, these limitations apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot lawfully be limited.
14. Apple App Store terms
If you obtained the App through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies in addition to these Terms. These Terms govern the Trackeon account and service and supplement that standard license. If these Terms conflict with a mandatory Apple platform term, the applicable Apple term controls to the extent of the conflict.
15. Changes to these Terms
We may update these Terms as the Services, providers, or legal requirements change. If we make material changes, we will provide notice in the App, on the Site, or by other reasonable means as required by law. Continued use after updated Terms take effect constitutes acceptance where permitted by law. The "Last updated" date shows the most recent revision.
16. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Before filing a claim, you and Trackeon agree to make a reasonable effort to resolve the dispute informally by contacting the other party. Subject to rights that cannot be waived, a dispute that cannot be resolved informally must be brought in the state or federal courts located in North Carolina, and you consent to those courts' jurisdiction.
Nothing in this section deprives you of mandatory consumer protections or venue rights under the law where you live.
17. Language
These Terms are currently available in English only, even though the App's interface is localized into other languages. In case of a conflict between translations, the English version governs to the extent permitted by law.
