Trackeon Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Justin Terry ("Trackeon," "we," "us") governing your use of the Trackeon mobile app (the "App"). By downloading, installing, creating an account for, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What Trackeon is
Trackeon is a golf launch-monitor App for iOS and Android. Using your phone's camera and microphone, it performs on-device analysis to estimate metrics such as ball speed, club speed, launch angle, spin, and carry and total distance. It also lets you maintain a golf bag, track shot history and stats, and optionally stream calculated shot data to a companion display through a QR-code-linked session.
Raw camera video and microphone audio used for analysis are not uploaded to Trackeon's servers, with one beta-only exception: you may explicitly choose to upload saved swing-capture files (short video clips plus camera metadata) to help us diagnose tracking problems. Our Privacy Policy explains the information the App does store and process, including these beta uploads.
2. Estimates only
Shot metrics produced by the App are estimates intended for entertainment, practice, and general training. They are generated by device-based sensor analysis and are not certified measurements or a substitute for a professional launch monitor, club fitting, coaching, or medical or physical advice. Results can vary with the device, setup, environment, equipment, and swing. Do not rely on the App's output for equipment purchases, competitive rankings, wagering, safety decisions, or any purpose requiring certified accuracy.
3. Safe use
Golf activity can cause serious injury or property damage. You are responsible for using the App safely. Securely mount or position your device, use an appropriate hitting area and protective equipment, confirm adequate clearance, and follow all facility and equipment rules. Do not swing or hit a ball when a person, animal, device, or property is in the possible path of the club or ball. Stop using the App if it distracts you or creates an unsafe condition.
4. Accounts and age requirements
- You may create an account with an email and password, Google Sign-In, or, on supported Apple devices, Sign in with Apple. An account is required to use the App.
- You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, your parent or legal guardian must review and accept these Terms and supervise your use of the App.
- You must provide accurate information and keep supported account information current.
- You are responsible for safeguarding your device and account credentials and for activity under your account. Notify us promptly if you believe your account has been compromised.
5. Privacy and your data
Our Privacy Policy explains how we collect, use, disclose, retain, and delete information. You retain ownership of the shot data you provide or generate through the App. You grant us a limited license to host, process, transmit, and display that data only as needed to provide, secure, support, and improve the service and as otherwise described in the Privacy Policy.
Calculated shot records are retained for the life of your account unless you delete a shot or your account. Deleting an individual shot does not currently recalculate cumulative lifetime stats.
6. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the App's source code, algorithms, or underlying models, except to the extent applicable law permits that activity despite this restriction.
- Abuse, overload, disrupt, damage, or interfere with the App or its infrastructure.
- Attempt to gain unauthorized access to the App, our systems, or another person's account or data.
- Circumvent security or access controls.
- Use the App for unlawful, fraudulent, harmful, or infringing purposes.
- Submit malicious code or content or use automated means to scrape or access the service without our permission.
We may investigate suspected violations and take proportionate action, including restricting access, as permitted by law.
7. Account deletion, suspension, and termination
- You may stop using the App at any time. You may delete individual shots or delete your account from the Account screen in the App.
- When account deletion completes, the active account and associated profile, bag, shot, aggregate-stat, and uploaded swing-capture records are removed. Limited security, authentication, diagnostic, legal-compliance, and backup records may remain temporarily as described in the Privacy Policy.
- We may suspend or terminate access if we reasonably believe you violated these Terms, abused the service, created risk or legal exposure, or harmed Trackeon, another user, or our infrastructure. Where practical and legally permitted, we will make reasonable efforts to notify you.
- Provisions that by their nature should survive termination, including ownership, warranty disclaimers, liability limitations, and dispute provisions, will survive.
8. Service availability and changes
The App is being offered as a developing service, including during beta. Features and compatibility may change, and we may modify, suspend, or discontinue some or all of the App. We will provide notice when reasonably practical if a change materially affects the service. We do not guarantee that stored data or any particular feature will always be available, so you should not use Trackeon as your only record of information you need to preserve.
9. Third-party services
The App relies on third-party services, including Supabase for backend and authentication services, Sentry for diagnostics and feedback, Google Sign-In and Sign in with Apple for optional authentication, Resend for account email delivery, Expo/EAS Update for App updates and infrastructure, and Apple and Google for App distribution and platform services. Your use of a third-party integration may also be subject to that provider's terms and privacy policy. See our Privacy Policy for more detail about the information these providers process.
We are not responsible for third-party services to the extent permitted by applicable law.
10. Intellectual property and license
The App, including its software, design, branding, and content other than user data, is owned by Justin Terry or the applicable licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable (except where applicable platform terms permit), revocable license to use the App on devices you own or control for its intended purpose, subject to these Terms and applicable platform rules. No other rights are granted.
Feedback you voluntarily provide about Trackeon may be used without restriction or compensation to improve the App, provided we handle personal information in that feedback according to the Privacy Policy.
11. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, or that shot metrics or stored information will be accurate, complete, or suitable for any purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Trackeon and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business, or goodwill, arising from or related to the App or these Terms, even if advised that such damages were possible.
To the maximum extent permitted by applicable law, our total aggregate liability arising from or relating to the App or these Terms will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, if any, or fifty US dollars (US$50), whichever is greater.
Some jurisdictions do not allow certain exclusions or liability limits. In those jurisdictions, these limitations apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot lawfully be limited.
13. Apple App Store terms
If you obtained the App through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies in addition to these Terms. These Terms govern the Trackeon account and service and supplement that standard license. If these Terms conflict with a mandatory Apple platform term, the applicable Apple term controls to the extent of the conflict.
14. Changes to these Terms
We may update these Terms as the App, providers, or legal requirements change. If we make material changes, we will provide notice in the App or by other reasonable means as required by law. Continued use after updated Terms take effect constitutes acceptance where permitted by law. The "Last updated" date shows the most recent revision.
15. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Before filing a claim, you and Trackeon agree to make a reasonable effort to resolve the dispute informally by contacting the other party. Subject to rights that cannot be waived, a dispute that cannot be resolved informally must be brought in the state or federal courts located in North Carolina, and you consent to those courts' jurisdiction.
Nothing in this section deprives you of mandatory consumer protections or venue rights under the law where you live.
16. Language
These Terms are currently available in English only, even though the App's interface is localized into other languages. In case of a conflict between translations, the English version governs to the extent permitted by law.
